Terms and conditions
Skischule Balla GmbH enters into contracts exclusively on the basis of these Terms and Conditions. The applicability of any terms and conditions of contractual partners of Skischule Balla GmbH is excluded. Any such terms and conditions are hereby expressly rejected.
For ease of reading, gender-neutral language has been omitted in the following text.
General
The following General Terms and Conditions (hereinafter: "GTC") apply exclusively to all services provided by Skischule Balla GmbH. Any differing or additional agreements shall only become part of the contract if explicitly confirmed in writing by Skischule Balla GmbH.
Terms and conditions relating to ski school operations of Skischule Balla GmbH
For the use of ski lifts, the transport conditions of "Zauchensee" Liftgesellschaft Benedikt Scheffer GmbH apply.
Skischule Balla GmbH is not a lift operator.
Contract conclusion
All offers made by Skischule Balla GmbH are non-binding. Online bookings only become valid after written confirmation by Skischule Balla GmbH.
General participation conditions for ski school operations of Skischule Balla GmbH
The customer must inform Skischule Balla GmbH truthfully and comprehensively about their skiing ability and experience and is responsible for having equipment appropriate to the current standards of winter sports (skiing, snowboarding, cross-country skiing, telemark skiing, tobogganing) and the external conditions.
Before lessons begin, the customer must have their equipment – especially bindings and binding settings – checked by a professional shop.
The customer must also disclose their health status and any physical impairments to Skischule Balla GmbH.
Group allocation for ski and snowboard courses is done by Skischule Balla GmbH. There is no entitlement to a specific group, and reassignments are possible.
The customer must follow the instructions of Skischule Balla GmbH and agrees to observe the FIS rules of conduct at all times.
Failure to follow instructions or being under the influence of drugs or alcohol entitles Skischule Balla GmbH to terminate the contract.
In such cases, no refund or partial refund will be granted, and the customer waives all rights to claim reimbursement, which is accepted by Skischule Balla GmbH.
If group sizes fall below four participants, Skischule Balla GmbH reserves the right to merge or end courses early. Unused lessons may be rescheduled.
There is no right to a specific instructor. Skischule Balla GmbH may change instructors at any time for operational reasons.
Prices and payment terms
Prices are listed in EURO and include 20% VAT, unless otherwise stated.
The current price lists displayed at the ski school office apply.
No liability is accepted for typographical or printing errors on brochures or websites (www.sport-pflug.at and www.skischule-balla.at).
Lift passes, tickets, and equipment are not included and must be purchased separately.
Full payment is due at the time of online booking unless otherwise agreed.
In the event of default, even if not the customer's fault, Skischule Balla GmbH may charge 6% annual interest.
The customer also agrees to cover collection and reminder costs.
Payment
Credit card payments to the ski school are processed by TREKKSOFT AG, Hauptstraße 15, 3800 Matten, Switzerland ("TREKKSOFT").
TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement.
The payment page is owned and operated by TREKKSOFT.

Liability
Skischule Balla GmbH is liable for damages only in cases of intent or gross negligence, unless otherwise required by law.
In any case, liability is limited to €5,000.00. Any further claims are waived and this waiver is accepted by Skischule Balla GmbH.
Any legal claims must be made within six months and will expire within one year from the triggering event.
Warranty
Skischule Balla GmbH does not guarantee a specific training result. A lack of progress is not considered a defect in service.
Cancellation and refund policy
Up to 7 days before service begins: full refund of all booked services.
Less than 7 days before: no refund, unless a written medical certificate is provided. In this case, the amount is refunded minus a €20 processing fee.
No-shows are not eligible for a refund.
If a course is interrupted due to illness or injury, a voucher (valid for 1 year) will be issued for the remaining value, minus a €20 fee, upon presentation of a doctor’s note (within 7 days).
Notification of withdrawal must be made immediately on-site.
No refund for other reasons or for failure to provide a medical certificate on time.
Refunds in the form of vouchers only apply to unused services (e.g., unstarted course days or private sessions).
To process refunds or vouchers, we require a doctor’s certificate, IBAN, participant name, and course details within 7 days by email: info(at)skischule-balla.at
Vouchers issued by Skischule Balla GmbH before April 21, 2025, expire on May 1, 2025.
Ski school bookings are non-transferable.
Weather-related cancellations
Lessons take place in all weather conditions. Refunds for cancellations made by the customer due to weather will not be issued.
If lift operations are canceled due to force majeure, affected lessons will be refunded only if they were not held.
Courses may also be canceled by the ski school due to low enrollment. In this case, customers will be notified as early as possible and offered rescheduling or a refund of unprovided services.
Consent to photo, audio, and video recordings
By participating, the customer grants free and irrevocable permission for Skischule Balla GmbH or third parties contracted by Skischule Balla GmbH to take and use photos, audio, and video recordings of the customer and their belongings during ski activities.
These recordings may be edited, published, broadcast, and used in all media formats (print, online, digital) for promotional and documentation purposes, both now and in the future.
This includes full, identifiable images.
All rights are transferred irrevocably, without compensation or limitation in time, place, or media type.
This also applies to derived advertising materials (flyers, posters, merchandise, etc.).
The customer waives any entitlement to compensation.
Skischule Balla GmbH is not obligated to use the rights granted.
Content of the online offer
Skischule Balla GmbH accepts no liability for the accuracy, completeness, or quality of the provided information.
Liability claims for damages resulting from the use or non-use of information, or from inaccurate or incomplete information, are excluded unless caused by proven intent or gross negligence.
All offers are non-binding and subject to change without notice.
Links
Skischule Balla GmbH is not responsible for external content linked on its website.
At the time of linking, no illegal content was known.
Skischule Balla GmbH has no influence on the current or future design and content of linked pages.
We therefore distance ourselves from any content changes made after linking.
This applies to all links on our website and to third-party entries in guest books, forums, or mailing lists.
Liability for illegal, incorrect, or incomplete content rests solely with the provider of the referenced page.
Data protection
We collect only the personal data necessary for fulfilling our services or which you provide voluntarily.
This includes, for example, names, addresses, phone numbers, birthdates, email addresses, gender, and media recordings.
Data protection is ensured through technical and organizational measures.
Despite this, we cannot guarantee full protection of data transmitted over the internet.
We assume no liability for unauthorized access or transmission errors (e.g., hacking or phishing).
We aim to detect and report data breaches promptly to the affected users and the relevant authorities.
Your rights
Please notify us of any changes to your personal data.
You have the right to withdraw consent to data processing at any time.
Cookies
This website uses cookies to enhance usability, effectiveness, and security.

The cookie contains only a non-personal ID number.

Severability clause
If any part of these terms is invalid or incomplete, this shall not affect the validity of the remaining provisions.
The invalid clause will be replaced with a legally valid one that most closely reflects the intended economic purpose.

Jurisdiction and applicable law
Austrian substantive law applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods.
The contractual language is German.
Unless mandatory legal jurisdictions apply, the competent court at the registered office of Skischule Balla GmbH shall have jurisdiction.
